{"id":5122,"collection_id":1,"collection":"bukhari","collection_name":"Sahih al-Bukhari","book_number":"86","bab_id":34.0,"english_bab_number":"34","arabic_bab_number":"34","hadith_number":"6835, 6836","our_hadith_number":60,"arabic_urn":159540,"arabic_bab_name":"باب مَنْ أَمَرَ غَيْرَ الإِمَامِ بِإِقَامَةِ الْحَدِّ غَائِبًا عَنْهُ","arabic_text":"اقْضِ بِكِتَابِ اللَّهِ‏.‏ فَقَامَ خَصْمُهُ فَقَالَ صَدَقَ اقْضِ لَهُ يَا رَسُولَ اللَّهِ بِكِتَابِ اللَّهِ، إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ بِمِائَةٍ مِنَ الْغَنَمِ وَوَلِيدَةٍ، ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ، فَزَعَمُوا أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ‏.‏ فَقَالَ ‏\"‏ وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ، أَمَّا الْغَنَمُ وَالْوَلِيدَةُ فَرَدٌّ عَلَيْكَ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَأَمَّا أَنْتَ يَا أُنَيْسُ فَاغْدُ عَلَى امْرَأَةِ هَذَا فَارْجُمْهَا ‏\"","arabic_transliteration":"aqdi bikitaabi alllahi‏.‏ faqaama khasmuhu faqaala sadaqa aqdi lahu yaa rasuwla alllahi bikitaabi alllahi، 'inna abniy kaana 'asiyfana 'alay hadhaa fazanay biamra'atihi fa'akhbaruwniy 'anna 'alay abniy alrrajma، faaftadaytu bimia'ahin mina alghanami wawaliydahin، thumma sa'altu 'ahla al'ilmi، faza'amuwa 'anna maa 'alay abniy jaldu mia'ahin wataghriybu 'aamin‏.‏ faqaala ‏\"‏ waalladhiy nafsiy biyadihi l'aqdiyanna baynakumaa bikitaabi alllahi، 'ammaa alghanamu waalwaliydahu faraddun 'alayka، wa'alay abnika jaldu mia'ahin wataghriybu 'aamin، wa'ammaa 'anta yaa 'unaysu faaghdu 'alay amra'ahi hadhaa faarjumhaa ‏\"","arabic_grade":"صحيح","english_urn":64320,"english_bab_name":"To carry out the legal punishment in the absence of the ruler","english_text":"<p>\nNarrated Abu Huraira and Zaid bin Khalid:\n\n<p>A bedouin came to the Prophet while he (the Prophet) was sitting, and said, \"O Allah's Apostle! Give \nyour verdict according to Allah's Laws (in our case).\" Then his opponent got up and said, \"He has told \nthe truth, O Allah's Apostle! Decide his case according to Allah's Laws. My son was a laborer \nworking for this person, and he committed illegal sexual intercourse with his wife, and the people told \nme that my son should be stoned to death, but I offered one-hundred sheep and a slave girl as a \nransom for him. Then I asked the religious learned people, and they told me that my son should be \nflogged with one-hundred stripes and be exiled for one year.\" The Prophet said, \"By Him in Whose \nHand my soul is, I will judge you according to Allah's Laws. The sheep and the slave girl will be \nreturned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you, \nO Unais! Go to the wife of this man (and if she confesses), stone her to death.\" So Unais went in the \nmorning and stoned her to death (after she had confessed).","english_grade":"Sahih","last_updated":null,"xrefs":""}
