{"id":23190,"collection_id":4,"collection":"abudawud","collection_name":"Sunan Abi Dawud","book_number":"40","bab_id":16.0,"english_bab_number":"16","arabic_bab_number":"16","hadith_number":"4399","our_hadith_number":49,"arabic_urn":944020,"arabic_bab_name":"باب فِي الْمَجْنُونِ يَسْرِقُ أَوْ يُصِيبُ حَدًّا","arabic_text":"حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا جَرِيرٌ، عَنِ الأَعْمَشِ، عَنْ أَبِي ظَبْيَانَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ أُتِيَ عُمَرُ بِمَجْنُونَةٍ قَدْ زَنَتْ فَاسْتَشَارَ فِيهَا أُنَاسًا فَأَمَرَ بِهَا عُمَرُ أَنْ تُرْجَمَ فَمُرَّ بِهَا عَلَى عَلِيِّ بْنِ أَبِي طَالِبٍ رِضْوَانُ اللَّهِ عَلَيْهِ فَقَالَ مَا شَأْنُ هَذِهِ قَالُوا مَجْنُونَةُ بَنِي فُلاَنٍ زَنَتْ فَأَمَرَ بِهَا عُمَرُ أَنْ تُرْجَمَ ‏.‏ قَالَ فَقَالَ ارْجِعُوا بِهَا ثُمَّ أَتَاهُ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ أَمَا عَلِمْتَ أَنَّ الْقَلَمَ قَدْ رُفِعَ عَنْ ثَلاَثَةٍ عَنِ الْمَجْنُونِ حَتَّى يَبْرَأَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَعْقِلَ قَالَ بَلَى ‏.‏ قَالَ فَمَا بَالُ هَذِهِ تُرْجَمُ قَالَ لاَ شَىْءَ ‏.‏ قَالَ فَأَرْسِلْهَا ‏.‏ قَالَ فَأَرْسَلَهَا ‏.‏ قَالَ فَجَعَلَ يُكَبِّرُ ‏.‏","arabic_transliteration":"haddathanaa 'uthmaanu bnu 'abiy shaybaha، haddathanaa jariyrun، 'ani al'a'mashi، 'an 'abiy zabyaana، 'ani abni 'abbaasin، qaala 'utiya 'umaru bimajnuwnahin qad zanat faastashaara fiyhaa 'unaasana fa'amara bihaa 'umaru 'an turjama famurra bihaa 'alay 'aliyyi bni 'abiy taalibin ridwaanu alllahi 'alayhi faqaala maa sha'nu hadhihi qaaluwa majnuwnahu baniy fulaanin zanat fa'amara bihaa 'umaru 'an turjama ‏.‏ qaala faqaala arji'uwa bihaa thumma 'ataahu faqaala yaa 'amiyra almu'miniyna 'amaa 'alimta 'anna alqalama qad rufi'a 'an thalaathahin 'ani almajnuwni hattay yabra'a wa'ani alnnaa'imi hattay yastayqiza wa'ani alssabiyyi hattay ya'qila qaala balay ‏.‏ qaala famaa baalu hadhihi turjamu qaala laa shay'a ‏.‏ qaala fa'arsilhaa ‏.‏ qaala fa'arsalahaa ‏.‏ qaala faja'ala yukabbiru ‏.‏","arabic_grade":"صحيح","english_urn":843850,"english_bab_name":"If an insane person steals or commits a crime that is subject to a had","english_text":"<p>\n\nNarrated Ali ibn AbuTalib:\n</p>\n\n\n\n<p>\n\nIbn Abbas said: A lunatic woman who had committed adultery was brought to Umar. He consulted the people and ordered that she should be stoned. \n</p>\n\n\n<p>\n\nAli ibn AbuTalib passed by and said: What is the matter with this (woman)? They said: This is a lunatic woman belonging to a certain family. She has committed adultery. Umar has given orders that she should be stoned.  \n</p>\n\n\n<p>\n\nHe said: Take her back. He then came to him and said: Commander of the Faithful, do you not know that there are three people whose actions are not recorded: a lunatic till he is restored to reason, a sleeper till he awakes, and a boy till he reaches puberty?  \n</p>\n\n\n<p>\n\nHe said: Yes.  He then asked: Why is it that this woman is being stoned?  \n</p>\n\n\n<p>\n\nHe said: There is nothing.  He then said: Let her go.
