{"id":23173,"collection_id":4,"collection":"abudawud","collection_name":"Sunan Abi Dawud","book_number":"40","bab_id":10.0,"english_bab_number":"10","arabic_bab_number":"10","hadith_number":"4382","our_hadith_number":32,"arabic_urn":943850,"arabic_bab_name":"باب فِي الاِمْتِحَانِ بِالضَّرْبِ","arabic_text":"حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ نَجْدَةَ، حَدَّثَنَا بَقِيَّةُ، حَدَّثَنَا صَفْوَانُ، حَدَّثَنَا أَزْهَرُ بْنُ عَبْدِ اللَّهِ الْحَرَازِيُّ، أَنَّ قَوْمًا، مِنَ الْكَلاَعِيِّينَ سُرِقَ لَهُمْ مَتَاعٌ فَاتَّهَمُوا أُنَاسًا مِنَ الْحَاكَةِ فَأَتَوُا النُّعْمَانَ بْنَ بَشِيرٍ صَاحِبَ النَّبِيِّ صلى الله عليه وسلم فَحَبَسَهُمْ أَيَّامًا ثُمَّ خَلَّى سَبِيلَهُمْ فَأَتَوُا النُّعْمَانَ فَقَالُوا خَلَّيْتَ سَبِيلَهُمْ بِغَيْرِ ضَرْبٍ وَلاَ امْتِحَانٍ ‏.‏ فَقَالَ النُّعْمَانُ مَا شِئْتُمْ إِنْ شِئْتُمْ أَنْ أَضْرِبَهُمْ فَإِنْ خَرَجَ مَتَاعُكُمْ فَذَاكَ وَإِلاَّ أَخَذْتُ مِنْ ظُهُورِكُمْ مِثْلَ مَا أَخَذْتُ مِنْ ظُهُورِهِمْ ‏.‏ فَقَالُوا هَذَا حُكْمُكَ فَقَالَ هَذَا حُكْمُ اللَّهِ وَحُكْمُ رَسُولِهِ صلى الله عليه وسلم ‏.‏ قَالَ أَبُو دَاوُدَ إِنَّمَا أَرْهَبَهُمْ بِهَذَا الْقَوْلِ أَىْ لاَ يَجِبُ الضَّرْبُ إِلاَّ بَعْدَ الاِعْتِرَافِ ‏.‏","arabic_transliteration":"haddathanaa 'abdu alwahhaabi bnu najdaha، haddathanaa baqiyyahu، haddathanaa safwaanu، haddathanaa 'azharu bnu 'abdi alllahi alharaaziyyu، 'anna qawmana، mina alkalaa'iyyiyna suriqa lahum mataa'un faattahamuwa 'unaasana mina alhaakahi fa'atawua alnnu'maana bna bashiyrin saahiba alnnabiyyi sly allh 'lyh wslm fahabasahum 'ayyaamana thumma khallay sabiylahum fa'atawua alnnu'maana faqaaluwa khallayta sabiylahum bighayri darbin walaa amtihaanin ‏.‏ faqaala alnnu'maanu maa shi'tum 'in shi'tum 'an 'adribahum fa'in kharaja mataa'ukum fadhaaka wa'ilaaa 'akhadhtu min zuhuwrikum mithla maa 'akhadhtu min zuhuwrihim ‏.‏ faqaaluwa hadhaa hukmuka faqaala hadhaa hukmu alllahi wahukmu rasuwlihi sly allh 'lyh wslm ‏.‏ qaala 'abuw daawuda 'innamaa 'arhabahum bihadhaa alqawli 'ay laa yajibu alddarbu 'ilaaa ba'da alai'tiraafi ‏.‏","arabic_grade":"حسن","english_urn":843690,"english_bab_name":"Testing by means of beating","english_text":"<p>\n\nAzhar ibn Abdullah al-Harari said: Some goods of the people of Kila' were stolen. They accused some men of the weavers (of theft). They came to an-Nu'man ibn Bashir, the companion of the Prophet (saws). He confined them for some days and then set them free.  \n</p>\n\n\n<p>\n\nThey came to an-Nu'man and said: You have set them free without beating and investigation. An-Nu'man said: What do you want? You want me to beat them. If your goods are found with them, then it is all right; otherwise, I shall take (retaliation) from your back as I have taken from their backs.  They asked: Is this your decision?  He said: This is the decision of Allah and His Apostle (saws).\n</p>\n\n<p>\nAbu Dawud said: By this statement he frightened them ; that is, beating is not necessary except after acknowledgement.\n</p>","english_grade":"Hasan","last_updated":null,"xrefs":""}
